Serious incident
Under the AI Act, an AI malfunction leading to death or serious harm, infrastructure disruption, rights infringement or major damage.
The EU AI Act defines a serious incident as an incident or malfunctioning of an AI system that directly or indirectly leads to death or serious harm to a person's health, serious and irreversible disruption of critical infrastructure, an infringement of obligations under Union law intended to protect fundamental rights, or serious harm to property or the environment. Providers of high-risk systems must report serious incidents to market surveillance authorities within set deadlines. Financial firms may also have separate incident reporting duties, such as those for ICT incidents under DORA.
